1. Agreement
These Terms of Service (“Terms”) govern your use of the “JustOpinion” website at https://www.justopinion.online, APIs, embeddable widget, and related services (together, the “Service”). By using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
2. The Service
JustOpinion provides hosted tools to add comment threads to websites, including storage, delivery, and moderation features. We may modify, suspend, or discontinue parts of the Service with reasonable notice where practical; we do not guarantee uninterrupted or error-free operation.
3. Accounts & eligibility
You must provide accurate registration information. You are responsible for keeping moderation links and secrets confidential. Customer sites are subject to plan limits and configuration stored with your account.
4. Acceptable use
You must not use the Service to:
- Violate applicable law or third-party rights
- Distribute malware, conduct attacks, or probe our systems without authorisation
- Send spam, harvest data abusively, or circumvent rate limits or technical controls
- Publish or solicit unlawful content (e.g. hate speech, non-consensual imagery, child exploitation, severe harassment), as determined in our reasonable judgment
We may suspend or terminate access for violations or risk to the Service or other users.
5. Customer content & licence
You retain rights to content you submit. You grant us a non-exclusive, worldwide licence to host, reproduce, process, transmit, and display such content solely to provide and improve the Service, including delivery to end users on your configured origins.
6. Privacy
Our Privacy policy explains how we process personal data. End users posting comments should also read the policy of the website where the widget appears.
7. Fees, trials, and changes
Paid plans, if offered, are described at Pricing. Prices, taxes, and payment processes may change with notice where required by law. Statutory consumer rights (including withdrawal) are addressed in our Refund & withdrawal policy.
8. Third-party services & embeds
Your site may integrate our script and styles. You are responsible for your own site and for complying with laws applicable to your visitors.
9. Warranty disclaimer
The Service is provided “as is” and “as available” to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement where allowed.
10. Limitation of liability
To the extent permitted by applicable law (including mandatory consumer law in the EU), our aggregate liability arising out of the Service is limited to the amounts you paid us for the Service in the twelve (12) months before the claim, or fifty euros (€50), whichever is higher. We are not liable for indirect or consequential damages except where such limitation is not allowed.
Nothing in these Terms excludes or limits liability for intent, gross negligence, injury to life, body or health, fraudulent misrepresentation, or any other liability that cannot be excluded under mandatory law.
11. Indemnity
You will defend and indemnify us against third-party claims arising from your content, your misuse of the Service, or your breach of these Terms, to the extent permitted by law.
12. Termination
You may stop using the Service at any time. We may terminate or suspend access with reason where appropriate, including for breach or legal requirements. Provisions that by nature should survive will survive.
13. Governing law & disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer in the EU/EEA, mandatory consumer protection rules of your country of residence remain unaffected.
If you are a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction for disputes arising from or in connection with these Terms is Berlin, Germany.
The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obliged to participate in consumer arbitration under the Verbraucherstreitbeilegungsgesetz (VSBG) unless we state otherwise.
